1.1 In this agreement unless the agreement otherwise states:
a) The "Company" is defined as Mums on Call, hereafter referred to as MoC.
b) The "Mum" is defined as any individual whose services are provided by MoC.
c) The "Client" or "Parent" is defined as any individual(s), company, or corporate body who has registered with MoC for the services of The Mum.
2.1 The Client shall pay to MoC, a Registration Fee of £15.00 upon signing hereof (date of registration). This amount will be paid to MoC quarterly until such time that The Client wishes to cancel the agreement by email/phone or in writing.
2.2 Upon payment of the registration fee, The Client shall be entitled to the full services of MoC.
2.3 A payment of £5.50 will be payable to MoC for EACH booking, at the time of booking. Therefore if two dates are booked at the same time, the booking fee of £11.00 will be due. Payment can be made through the website, or by cheque. Dates of bookings will only be confirmed after payment of the booking fee has been received.
2.4 The Client will pay The Mum at the end of the service, a minimum of £16 for two hours or £24 for three hours. For every 15 minutes The Client is late over the agreed booking time, an additional £8 will become payable.
2.5 Cancellations of a booking less than 24 hours before service is due to start will incur full payment from The Client for the total number of hours of the booking. The booking fee is non-refundable.
2.6 If MoC increase their registration or hourly rate, The Client will be notified in writing one month prior to the increase.
3.1 It is agreed that The Client shall only book the services of The Mum through MoC. The Client agrees not to approach The Mum directly, nor to instruct anyone else to do so on The Client's behalf.
3.2 In the event that The Client acts in breach of this agreement and is found to have approached The Mum without reference to, or expressed prior consent of MoC, MoC reserve the right to terminate this agreement, cancelling The Client's registration with MoC and no further introductions will be made.
3.3 The Client undertakes to notify MoC in respect of any cause of dissatisfaction in the performance or characteristics of The Mum.
4.1 It is agreed that The Mum will only accept bookings for The Client through MoC and after being introduced by MoC will not accept offers of bookings with The Client directly but only through MoC.
4.2 In the event that The Mum acts in breach of this agreement and is found to have taken a booking with The Client without prior consent of MoC, MoC reserve the right to terminate this agreement, cancelling any of The Mum's future bookings with MoC.
4.3 For the avoidance of doubt, MoC does not employ The Mum. The Mum is self-employed and uses MoC as an employment service.
4.4 The Mum agrees to notify MoC of any changes to their availability or circumstances which may hinder or alter their ability to serve as a Mum on Call.
4.5 The Mum will endeavour to avoid cancelling any bookings she has already agreed to with less than 24 hours notice unless due to unforeseen circumstances.
5.1 MoC endeavours to provide suitable and reliable Mums and will interview all Mums and make all reasonable enquiries to verify references provided by and any qualifications claimed by The Mum unless MoC notifies The Client otherwise.
6.1 MoC values your privacy. MoC will not share your information with any other company for marketing or any other purpose.
6.2. The Client shall not request from The Mum or from any third party, personal contact details of The Mum. Any such request for information must be directed to MoC.
7.1 MoC accepts no responsibility for any expense, injury, delay, damage or loss of any kind arising out of the service of The Mum.
